Appeal from an order of the Supreme Court (Hummel, J.), entered March 14, 2003 in Ulster County, which, inter aha, granted defendants’ motion for partial summary judgment dismissing the complaint.

Plaintiffs are taxpayers who own residential property in the Town of Greenburgh, Westchester County, which is adjacent to the Elmwood Country Day School, a year-round school founded and in operation since 1957.
