Action upon a probate bond, brought to the Superior Court in New London County and tried to the jury before Rorabacic, J., after a demurrer to the second and third defenses had been overruled and one to the fourth defense sustained (Rorabacic, J.') ; verdict and judgment for the plaintiff for |104 damages, and appeal by it for alleged errors in the rulings and charge of the court.

The complaint alleges in substance that the defendants, Thresher as principal and Potter as surety, in December, 1892, gave a probate bond in the penal sum of $1,200 for the faithful performance by Thresher of his duties as trustee under the provisions of the will of John Butler, deceased, to which position Thresher had been duly appointed.
