I concur in the majority opinion but only in the result.

This appeal presents the Court with one question as to the interpretation of N. J. S. A. 19 :34-62 and 19 :34-63: whether the court can compel a prosecutor to present evidence to the grand jury as to violations of election laws. The factual occurrences giving rise to this issue should he briefly summarized as an aid in understanding my position.

Three days prior to the Borough of Ringwood mayoral election of November 3, 1970, the Ringwood Fact Finding Committee circulated a pamphlet critical of the proposed Ringwood Solid Waste Authority…
