In this action of contract the plaintiff seeks to recover $2,000.00 against the defendant as a surety on a bond. The bond was given to dissolve what was described therein as an equitable attachment against one Shimar, Inc. The defendant answered by way of a general denial and failure of consideration.

Evidence tended to show that on or about May 3rd, 1953, the plaintiff brought a bill in equity against Shimar, Inc., and Music Hall Corporation. Prior to trial a bond in the amount of $2,000.00 was executed by Shimar, Inc., as principal and the defendant and two others as sureties and delivered…
