The plaintiff exhibited an account for allowance against the estate of Daniel Morris in the probate court of Butler county. After the presentation of the account he filed an application for a change of venue on the ground, that the judge of the probate court was biased against him and that the judge’s mind was under the undue influence of the opposite party. The probate judge granted a change of venue to the county court, where the case was tried, resulting in a judgment for the defendant.
