MEMORANDUM OPINION AND ORDER

HADEN, Chief Judge.

Pending is Defendant’s motion for an award of attorney fees and costs. Plaintiff filed this declaratory judgment action seeking a determination of which party was legally responsible for providing insurance coverage for a tractor trailer-automobile accident that occurred on June 1, 1993. After the parties filed cross motions for summary judgment, this Court, by Memorandum Opinion and Order entered April 25, 1995, granted declaratory judgment in favor of the Defendant and ordered the Plaintiff to provide primary insurance coverage.
