Appellant, Jones, was a surety on the bond of one Thomas J. Orme, for the faithful discharge of the duties of the latter as general administrator of Mont*278gomery county. The appointment of Orme to this office was made in 1856, and the bond was then executed, with a penalty of $50,000.
