MEMORANDUM OPINION AND ORDER

ASPEN, District Judge:

The Secretary of Labor (“the Secretary”) brought this action against the defendant-union (“the Union”) under § 401(e) of the Labor-Management Reporting and Disclosure Act of 1959, 29 U.S.C. § 481(e), alleging that the Union denied its members a reasonable chance for nominating candidates in an election for Secretary of the Union. The parties agree on the material facts and have filed cross-motions for summary judgment under Ped.R.Civ.P. 56, along with excellent supporting memoranda.
