MEMORANDUM OPINION AND ORDER
SHADUR, District Judge.
Ruby Brooks (“Brooks”) seeks judicial review of a final decision of the Secretary *586of Health and Human Services (“Secretary”) denying Brooks’ claim for supplemental security income (“SSI”) benefits under the Social Security Act (“Act”), 42 U.S.C. §§ 416(i), 423 and 1381a.1 As is customary in these cases, the parties have filed Fed.R.Civ.P. (“Rule”) 56 cross-motions for summary judgment.2 For the reasons stated in this memorandum opinion and order, Brooks’ motion is granted and Secretary’s is denied.
