Croxton as administrator of the estate of A. A. Thompson, deceased, foreclosed a bill of sale executed by Mrs. J. T. Barrow to Thompson in his lifetime to secure a note of $1000. Execution issued for principal and interest, and levy was made. Mrs. Barrow filed an affidavit of illegality, setting up that she had previously paid the interest, and that on January 4, 1936, Thompson, then in life, gave her a receipt for $980 as a gift on the note secured by the bill of sale; that at the time he was indebted to her in the amount of $20 which was applied on the note, and that by the…
