RICE, Chief Justice.

This is a suit for damages brought by the surviving widow, and other members of the family of C. L. Barnaby, against the Missouri-Kansas-Texas Railroad Company of Texas, because of the death of C. L. Barnaby while an employee of defendant. Mr. Barnaby had been in the service of the defendant on its Texas Central branch, in the capacity of locomotive engineer, for about thirty years. The tragedy occurred a few miles west of Walnut Springs, in McLennan county, Texas, on April 1, 1938, while Mr. Barnaby was at the throttle of his engine proceeding east with his freight train…
