PRIOR PROCEEDINGS
Plaintiff, Appellee, Quality Foods, Inc. [hereinafter Quality] filed suit against U.S. Fire Insurance Company [hereinafter U.S. Fire] in the circuit court of Mobile County, Alabama. Appellee sought recovery, under an insurance policy issued by U.S. Fire to Quality, in the amount of three million dollars compensatory and property damages and two million dollars in punitive damages. Appellant removed the action to federal district court pursuant to 28 U.S.C.A. §§ 1332 and 1441. The jury found for Quality in the amount of $50,000.00 building damages…
