The proceeding which furnishes the basis of this appeal was instituted by the affidavit of thirty-three freeholders of the town of Hempstead, which was presented to a justice of - the Supreme.Court and prayed for an investigation of the financial affairs of the town, the accounts of the officers and of each and all of the bills. and *324accounts audited and allowed by the officers of the town during the year 1896.
