Plaintiff, an addicted cigarette smoker for most of her adult life, had contracted, by 1988, a series of smoking-related illnesses, including asthma, emphysema, and chronic obstructive pulmonary disease (COPD). Five years later, she was diagnosed as having lung cancer. She brought suit against the Chesterfield and Marlboro cigarette companies, Liggett Group, Inc., Liggett & Myers, Inc., and Philip Morris, Inc., within the statutory limitations period of three years from the diagnosis of cancer but not within three years of the onset of the earlier respiratory…
