This matter comes before us upon an appeal from the refusal of the county treasurer to issue a retail dispenser’s beverage license upon an application made by appellant for such a license at a hotel situated on Main Street in the Borough of Berrysburg, Dauphin County, Pa.

The reason for the refusal is that at an election held in said borough on November 3, 1936, the majority voted against the granting of such licenses.
