LOGAN, Circuit Judge.
This ease was brought pursuant to 42 U.S.C. § 1983 to recover for alleged deprivation of property rights and conversion. The trial court granted a motion by the defendant First State Bank of Sierra County (First State) to dismiss for failure to state a claim. The plaintiff Pas P. Torres, Jr. (Torres) appealed, and this court in Torres v. First State Bank, 550 F.2d 1255 (10th Cir. 1977), reversed and remanded for further proceedings.
