PRINCE, United States Magistrate Judge.
Virginia Beach Mechanical Services, Inc., (“VBMS”), the use plaintiff, brings this action seeking damages against the defendants, SAMCO Construction Company (“SAMCO”), and its surety, the National Grange Mutual Insurance Company, for breach of two subcontracts pursuant to the Miller Act, 40 U.S.C. § 270a et seq. The defendants have denied liability and the defendant SAMCO has counterclaimed, alleging that VBMS failed to properly and fully complete the work required by the two subcontracts at issue.
