¶ 1. The motion for rehearing is denied. We withdraw our original opinion and substitute this modified opinion.

¶ 2. Kenneth R. Goldsmith was convicted of grand larceny in the Circuit Court of Rankin County, Mississippi. He was sentenced as a habitual offender to serve life without parole.
