MEMORANDUM OPINION

Plaintiff Federal Savings & Loan Insurance Corporation (“FSLIC”) filed this suit hoping to recover amounts allegedly due under a lease originally made between United Leasing Corporation (“United Leasing”) and C & J Oil Company, Inc. (“C & J”). The defendants have counterclaimed seeking damages for malicious prosecution. Currently before the court are the defendants’ motion for summary judgment and plaintiff’s motion for summary judgment on the defendants’ counterclaim.
