FOURNET, Justice.

The late Bernard McCloskey intervened in the liquidation of the Hibernia Bank & Trust Company seeking to be released from his obligation as endorser to pay a certain promissory note executed by John T. Gibbons, Jr., for the principal sum of $8,500. The liquidators of the bank answered denying that the intervenor was entitled to the relief sought and further averred that this note was lawfully pledged and delivered to the Reconstruction Finance Corporation by the bank for a valuable consideration and before maturity.
