This is an action in ejectment. At the trial plaintiff submitted a point for binding instructions in his favor which was refused, and the jury rendered a “verdict in favor of the plaintiff upon condition- that the plaintiff reimburse the defendant in the amount of $680.07.” Thereafter plaintiff filed a motion for new trial, a motion to mold the verdict into a verdict for plaintiff, and also a motion for judgment n. o. v.
