Reversing.
The appellant and defendant below, Charles T. Tiernay, shot and killed Rose McChord, in Jefferson county, Ky. Upon his trial under an indictment charg ing Mm with murder, he was convicted, and his punishment fixed at death. On tMs appeal his counsel argue three grounds for reversal of the judgment, which are: (1) Thát the conviction of defendant of the murder ■charge against him was and is flagrantly against the evidence; (2) improper and prejudicial remarks of attorney for the commonwealth in his closing argument to the jury; and (3) erroneous…
