OPINION
RYAN, Circuit Judge.
The petitioner, Farid Masud Asad, appeals the district court’s decision dismissing his habeas corpus petition under 28 U.S.C. § 2241. Asad contends that the district court erroneously concluded that he was ineligible for a waiver of deportation under former section 212(c) of the Immigration and Nationality Act of 1952(INA), 8 U.S.C. § 1101-1646, in light of section 440(d) of the Antiterrorism and Effective Death Penalty Act of 1996 (AEDPA), Pub L.
