Morris Ernest appeals from a judgment against him in the amount of $750, in fa*348vor of O-wen Moore, for personal injuries sustained by Moore when he scratched or cut his leg on a nail sticking out of a lettuce crate on the sidewalk in front of Ernest’s produce market in Louisville.
The sole contention of the appellant is that the evidence does not support a judgment against him personally, because it does not establish that he, rather than one of the employes of the market, was responsible for the position and condition of the lettuce crate. Liability under the doctrine of…
