MEMORANDUM OF DECISION AND ORDER ON HABEAS CORPUS

WEIGEL, District Judge.

Ynez S. Cuevas, an inmate at San Quentin state penitentiary, has filed in this Court a petition for a writ of habeas corpus in which he alleges that he is presently in custody in violation of his federal constitutional rights. Pursuant to the requirements of 28 U.S.C. § 2243, this Court issued an Order To Show Cause, respondent filed his return and, after counsel was appointed to represent petitioner, an evidentiary hearing was held before this Court on June 7, 1966.
