In March 1978 appellant McKenzie’s husband was struck and killed by a train owned by appellee Seaboard System Railroad, Inc. (“Seaboard”), and operated by appellee Barronton. Acting both individually and as administratrix for the decedent’s estate, Mrs. McKenzie brought a wrongful death action in March 1980 against appellees, alleging that they were jointly and severally liable and seeking damages in the amount of several hundred thousand dollars. On October 31, 1983, she voluntarily dismissed the action without prejudice, pursuant to OCGA § 9-11-41 (a), and renewed it…
