HAWKINS, Judge. —

Upon a requisition from the Governor of the'State of Minnesota the Governor of this State issued an extradition warrant authorizing the return of relator to the de manding state upon a charge of uttering a forged instrument, which offense is punishable in said state by imprisonment in the penitentiary for not more than ten years. In habeas corpus proceedings before a district judge relator challenged the legality of the issuance of the extradition writ, and upon béing remanded by the district judge gave notice of appeal to, the Court of Criminal Appeals of the State of Texas,…
