KRUEGER, Judge.

The conviction is for the offense of an assault with intent to murder. The punishment assessed is confinement in the state penitentiary for a term of two years.

There are but two questions presented for review. One relates to the sufficiency of the evidence to justify and sustain the conviction, and. the other relates to some remarks made by the District Attorney in his argument to the jury.
