— In a proceeding pursuant to CPLR article 78 to compel the New York State Board of Parole to grant the petitioner a new minimum period of imprisonment hearing, the appeal is from a judgment of the Supreme Court, Dutchess County, dated June 21, 1979, which annulled the determination fixing petitioner’s minimum period of imprisonment and remanded the matter for reconsideration. Judgment affirmed, without costs or disbursements.
