Appeal from an order of the Supreme Court (Dowd, J.), entered July 30, 2001 in Otsego County, which, inter alia, denied defendants’ motion for summary judgment dismissing the complaint.
*851On. December 28, 1989, Steven J. Blumenkrantz (hereinafter decedent) and defendant Edward W.
