This matter comes before the Court on Defendants’ Motion for Summary Judgment on Plaintiffs’ Employee Retirement Income Security Act of 1974 (“ERISA”) claims that Defendants (1) arbitrarily and capriciously denied Plaintiffs early retirement benefits, (2) breached their fiduciary duty by failing to notify Plaintiffs of amendments to the early retirement plan, and (3) engaged in unlawful discrimination by denying Plaintiffs participation in the early retirement plan.
