MEMORANDUM
MCCLURE, District Judge.
BACKGROUND:
On November 5, 2001, plaintiffs Richard Zugarek and Elaine Zugarek, husband and wife, commenced this civil rights action against defendants with the filing of a complaint pursuant to 42 U.S.C. § 1983. 2 Plaintiffs’ complaint also includes the supplemental state law claims of defamation, intentional infliction of emotional distress, and loss of consortium.
