Kelly L. Fergason and Shannon A. Fergason (the “Debtors”) filed this case under chapter 7 of the Bankruptcy Code on November 14, 2002. The United States Trustee has filed a motion to dismiss under 11 U.S.C. § 707(b) alleging that allowing the Debtors to obtain a chapter 7 discharge would be an abuse of the Bankruptcy Code within the meaning of § 707(b).
