KLINGEMAN, Justice.

This is a workmen’s compensation case in which Francisco G. Garces, appellee herein and plaintiff below, recovered a judgment against Texas Employers’ Insurance Association, appellant herein and defendant below, for total and permanent incapacity based upon a jury verdict of total and permanent incapacity. The jury also found that $49 per week less an attorney’s fee of 25% was inadequate to meet the necessities of plaintiff and found that $45 per week free and clear of attorney’s fees should be paid to plaintiff.
