The first alleges, in substance, that the plaintiffs were partners doing business under the firm name and style of James McWhinney & Company; that on or about the 7th of June, 1864, the defendant was a corporation, owning and operating a line of railroad extending, from a point on the *437Ohio river, opposite the town of Bellaire, Ohio, to the city of Washington, D.
