Wentzell v. Timberlands, Inc.
Supreme Judicial Court of Maine
1Opinion of the Court
GLASSMAN, Justice.
The appellants, Timberlands, Inc. and Liberty Mutual Insurance Company, appeal from a pro forma decree of the Superior Court, Oxford County, which affirmed a decision of the Workers’ Compensation Commission dated March 15, 1979. The Commission dismissed the appellants’ “Petition To Invoke Section 57” (39 M.R.S.A. § 57), the Second Injury Fund provision of the Workers’ Compensation Act, on the alternative grounds that it was without jurisdiction to hear the petition or, assuming jurisdiction, that the petition was barred by the doctrine of res judicata. We affirm the judgment.
