—In a proceeding pursuant to CPLR article 75 to vacate the award of a master arbitrator, dated April 26, 2001, and amended May 28, 2001, which set aside an award of an arbitrator, dated February 5, 2001, Spine Americare Medical P.C., appeals from a judgment of the Supreme Court, Nassau County (Parga, J.), dated November 7, 2001, which granted the petition, vacated the award of the master arbitrator, and reinstated and confirmed the award dated February 5, 2001, denying the appellant’s claim for fees for medical services rendered.
