Affirming.

John Bowman and Clarence Alford were jointly indicted hv the grand jury of Marion County at its April term, 1911. In said indictment they were charged with having committed the crime of rape upon one Minnie *488Lamb on February 26th, 1911. A special term of the Marion Circuit Court was called for June 13th, 1911, to try this case. The trial was entered upon, a jury procured and sworn, but before any evidence was heard a general demurrer was filed to the indictment, and said demurrer was sustained, with leave to re-submit the case to the grand jury.
