The defendant appeals his conviction for theft of a motor vehicle. Held:
The defendant enumerates but one error. He alleges "The trial court erred in denying the appellant’s motion for directed verdict. The trial court allowed the State to allege, indict and convict for the theft of one Dodge Charger, without producing the rightful property owner of said vehicle to testify in open court.” This is not the same motion made at trial.
