' KING, J.:

An action for divorce was brought against the petitioner by Sadie Kelsey. The petitioner specifically denied that *404there had been a marriage between him and the plaintiff. Upon application for temporary alimony and suit money, the court ordered that, until the further order of the court, defendant in the action should pay $40 per month to plaintiff, and that within 20 days from September 30, 1895, he should pay the further sum of $?5 suit money and $200 counsel fees.
