On October 1, 1942, the defendant issued a policy on the life of Albert Rappe. He died May 26, 1943. This action is- by the beneficiary named in the policy. The defendant relies entirely upon the affirmative defence set forth in its answer that in the application for the policy the insured falsely represented (1) that his health was good; (2) that he had never been an “inmate” of a hospital; (3) that he had no “usual medical attendant”; (4) that he had never had any “illness”; and (5) “especially” that he had never had a disease of the heart.
