Murder, second degree: sentence, forty years.

On March 20, 1970, -defendant filed a “Motion to Quash Indictment and Refill *541the Jury Box.” The defendant, a Negro, alleged therein systematic exclusion of Negroes from the jury roll in the Bessemer Division of Jefferson County.
