This case involves the probate of an instrument purporting to be the last will of David Bryans, deceased. He died February i, 1917, a resident of Henderson county, Illinois. A petition to probate the instrument in question was filed in the county court of that county February 7, 1917. This petition only named as “heirs-at-law and legatees” the nine children of the deceased. Notices were sent to them by the clerk, and on April 2, the date set for hearing in the county court, that court found “that the proof fails to support the allegations of said petition” and refused to probate said…
