From the complaint and the bill of particulars furnished by the plaintiff, which, for the purposes of the motion, must be read together, it appears that the defendant is the proprietor of and engaged in conducting a place of public entertainment in a hamlet known as Indian River in the town of Croghan, Lewis county, N.
