In October 1995, Douglas Fontaine was injured when he fell in a stairwell at a Home Depot office facility. Fontaine filed this premises liability action against The Home Depot, Inc. in October 1997. Home Depot, Inc. answered that it was an improper defendant because it had no interest in the premises which was the subject of the action.
