Appeal by the defendant, The Third Avenue Railroad Company, from -an order of the Supreme Court, made at the Hew York Special Term and entered in the office of the clerk of the county of Hew York on the 31st day of December, 1896, granting an injunction pendente lite.

1Opinion of the Court

Rumsey, J.:. The plaintiffs are the owners of a piece of land situated on the corner of One Hundred and Eighty-second street and Kingsbridge road, or Broadway. The buildings upon the.place have been used for many years as a road house or hotel, which is much frequented by people who are accustomed" to drive along the- Kingsbridge road, and by bicyclists in their excursions in that direction.

The defendant is the owner and occupant of a street railroad extending through the city of Hew York to a point on One Hundred and Sixty-second street.
