HALE, Justice.

Appellees brought this suit against appellants for the partition of certain property and an accounting with respect thereto. The action involves the construction and application of the probated will of J. B. -Anderson, deceased. Appellants are the two children of the testator by his second marriage and appellees are the five children (or their heirs) of the testator by his first marriage.
