Appellee, E. W. Newman, was, in the year 1922, and is now, the owner of a grist mill and water power site situated on the South Anna river in Hanover county, approximately three miles from the town of Ashland. Appellant maintains and operates a water works and sewer system as a municipal enterprise for gain, and acquires the power and water used by it in the operation of its plants from the appellee, under a written contract dated June 20, 1922.
