Warren Harris appeals the denial by the United States District Court for the Southern District of New York, Lee P. Gagliardi, Judge, of his petition pursuant to 28 U.S.C. § 2254 for a writ of habeas corpus. Harris was convicted after a jury trial in the New York Supreme Court, Queens County, of manslaughter in the first degree. His conviction was affirmed by the appellate division, second department, People v.
