HEADNOTES: FORECLOSURE SALES – SURPLUS FUNDS – WASTE The purchaser of real property at a foreclosure sale is entitled to a remedy if the purchaser can prove that the property’s former owner committed voluntary waste following the foreclosure sale, while the former owner was still in lawful possession of the property, because such waste prejudices the purchaser’s inchoate equitable interest in the foreclosed property.
